1. Description of Service
Monster Chat Box provides an embeddable chat widget that utilizes Artificial Intelligence (AI) and real-time communication tools to facilitate interaction between website owners and their visitors.
2. User Accounts
- Registration: To use certain features, you must register for an account. You agree to provide accurate and complete information.
- Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Eligibility: You must be at least 18 years old to use this Service.
3. Subscriptions and Payments
- Plans: Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis.
- Payments: All payments are processed via Stripe. By subscribing, you authorize us to charge the applicable fees to your provided payment method.
- Cancellations: You may cancel your Subscription at any time through your dashboard. Cancellations will take effect at the end of the current billing cycle.
- Refunds: Except when required by law, paid subscription fees are non-refundable.
4. Acceptable Use
You agree not to use the Service to:
- Violate any local, state, national, or international law.
- Transmit any content that is unlawful, defamatory, harassing, or otherwise objectionable.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorized access to our systems or related networks.
- Use the Service for “spamming” or any unauthorized advertising.
5. AI Usage and Content
- Knowledge Base: You are solely responsible for the content, documents, and data you upload to train your AI (“Customer Content”).
- AI Accuracy: While we strive for high accuracy, AI-generated responses are provided “as-is.” Go Monster Marketing is not responsible for any incorrect information, “hallucinations,” or actions taken by visitors based on AI responses.
- BYOK: If you utilize the “Bring Your Own Key” (BYOK) feature, you are responsible for maintaining your own relationship and billing with your AI provider (e.g., OpenAI or Anthropic).
6. Intellectual Property
- Our Property: The Service, its original content (excluding Customer Content), features, and functionality are the exclusive property of Go Monster Marketing.
- License to Use: We grant you a limited, non-exclusive, non-transferable license to embed the Monster Chat Box widget on your authorized domains.
7. Limitation of Liability
To the maximum extent permitted by law, Go Monster Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the Service.
8. Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Go Monster Marketing operates, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days’ notice before any new terms take effect.
